SanJosePolicePatchDecember 1, 2009 – The San Jose City Council is expected to formally approve a payment of $97,500 to settle a police brutality claim by a San Jose business owner and his nephew.

Ascencion Calderon and his nephew, Samuel Santana, filed suit against the city after they claimed that San Jose police officers had used excessive force and made racial epithets while arresting them during a July 2006 traffic stop.

Calderon, who was 65-years-old at the time, and Santana, who was 25-years-old, were booked on one count each of suspicion of resisting or interfering with an officer.

The charges were later dismissed.

The settlement has been tentatively approved in a previous closed City Council session, with formal approval expected to come when the council meets Tuesday.
